Art Revenue Coaching Purchase Terms and Conditions

Our core ethos for ARC is to teach artist the practical skills required to sell their artwork. This document details from the outset the way in which we will deliver our services to you. If you are planning to join ARC (“the Membership”) then you must read these terms and conditions in full prior to purchasing.

 

  1.  Membership Terms & Conditions (‘Terms’): Key Details

These Terms cannot be varied and in proceeding to purchase the Membership you will be deemed to have accepted these Terms. The Terms set out below apply to the services offered by ARC.  Please read them carefully as they affect your rights and liabilities under law and set out the Terms under which ARC (“we”, “our” or “us”) provide services to you, as purchaser of the Membership. These Terms are subject to any rights you have under consumer law to which we are bound and which cannot be waived by contract.

Please be aware that we may update these Terms at any time. Your continued use of the Membership indicates your acceptance of the terms and agreement to any changes.

 

  1.  Membership Outline

ARC is a Membership is for Artists that are seeking to develop a full or part-time business selling their artwork. The Membership is an ongoing commitment where you can get regular support and guidance.

 

The aim is to provide content in the form of Live Calls, Webinars and Digital Training Courses that will teach members the techniques Josie Lewis has used in the development of her own business, as well as insights and options from Josie Lewis on the aspects of Artistic Voice, Business, and Selling.  This membership is not tailored to any one person or art medium.  While the content shared is applicable for most skill and experience levels the Membership is best suited to those whom have at least one year of experience making art.  

 

  1.  Eligibility

You must be 18 years of age or older to register as a member

 

  1.  Membership Specifics

The ARC Program membership can be billed on a monthly or yearly basis.  The program content is the same for both billing options.

Description of Features:

Live Call w/Q&A Session

The Live Calls will typically be led by Josie Lewis.  From time to time they may also feature experts that specialize in different areas of Art, Sales, and Business.

These events will take place monthly utilizing ZOOM (or equivalent digital meeting platform).  

During each Live Call, members in attendance will have the ability to ask a questions to Josie. Though Josie will attempt to answer all questions, there is not a guarantee that every question will be answered.

The Monthly Live Calls are typically recorded in their entirety and made available to all active members for a period of at least 3 months by accessing it through the Membership website.

Training Video Library

ARC has a digital library of art business training modules that can be access through the ARC website.  The training material is taken from Josie’s personal experience as a successful Artist and Art Business entrepreneur. 

Behind the Scenes Training

Behind the Scenes content can take the form of a pre-recorded video or a live call, and it focuses on Josie showing how she or another successful entrepreneur performs various important tasks or processes at her [or their] company.

 

All Behind the Scenes Training videos or Live Calls will be stored and viewable on the ARC Membership website by active members.

Private Community

Active members will have have access to a private chat group. The intention of this chat group is to provide community support and information to members.

From time to Josie Lewis may post and offer support in the chat group but there is no guarantee that posts will be responded to.

We make no guarantees as to the availability of the group and/or the content within the group at any time. 

Mastermind Group

The Mastermind Group is the perfect combination of peer-to-peer networking and friendly support as Members work towards their tangible goals. 

Mastermind Groups are typically held once per month via ZOOM (or equivalent digital meeting platform). 

During these events, members will be placed in to small group to discuss a themed topic.  The groups will be randomly selected.  The meetings will be facilitated by Team Josie staff and time-to-time Josie Lewis will make a special appearance. 

 

 Art Critique

ARC Art Critique is an excellent learning tool for artist focused on developing their unique voice.  During these live events, Team Josie member will perform an art critique for members who volunteer. A limited number of people will be selected for a critique during each call.  Selections are conducted on a first come, first served bases.  

ARC Critique will typically be offered once per month and is held on ZOOM (or equivalent digital meeting platform).   

 

  1.  Behaviour

It is requested that at all times your behaviour towards others is polite and respectful. Should your behaviour be deemed offensive or inappropriate we reserve the right to immediately remove you from the Membership.

 

  1.  Membership Fees and Payment Terms

The cost of the Membership is set at the time you subscribe. On subscription you select one of the following membership package level options:

  1. ARC Monthly Membership: By selecting this option, you will agree to monthly payments via from either Stripe or Paypal which will be taken each month.

The Membership is an ongoing monthly subscription and payment will be taken on the same day each month.

  1. ARC Yearly Membership: By selecting this option, you will agree to a yearly payment via from either Stripe or Paypal which will be taken each year.

The Membership is an ongoing yearly subscription and payment will be taken on the same day each year.

 

  1.  Refunds and Cancellation

It is our aim that you will be completely happy with the Membership and you find motivation, support, and valuable training that will enable you to grow your Art Business. However, we appreciate that there may come a time when you wish to leave the Membership.

You have the right to cancel and obtain a full refund within 7 calendar days from the initial start date of subscription with ARC. Refund requests must be made in writing to [email protected] and a full refund will be provided within 10 working days.

There is no obligation on us to refund any amounts paid where cancellation requests are made following the 7 day cancellation period.

Notwithstanding any right or remedy available to us, we may cancel your Membership with immediate effect

  • If you fail to pay your Membership fees by the relevant due date;
  • If you commit a repudiatory breach of the Terms of this agreement;
  • As decided at our sole discretion from time to time

 

  1.  Contact and Schedule

It is the intention that the Membership will run continuously and that any training material, live call Q&As will be provided as set out above. Should an unforeseen reason arise which cause a session(s) to be postponed they will be re-arranged as soon as possible.

  1.  Disclaimers

We make no guarantees or claims as to the success of any member. Each individual is unique and their abilities are unique to them. The aim is that we provide our Members access to learning material, support, and inspiration that will help them sell their artwork.  All training provided will be general information and guidance and will not be bespoke advice. We are not responsible for any action or inaction which you take as a result of the information within the Membership.

We are not responsible for any loss of opportunity or any investments which you make. No content in this Membership should be construed as medical advice, whether mental or physical.

We ask that all members in the Membership respect the rights of others in respect of their behavior and privacy. We will not be responsible for the action of any members including for any disclosures made by any members based on information which has been shared within the Membership.

 

  1.  Limitation of Liability and Indemnification

To the fullest extent permitted by applicable laws, we limit liability and responsibility for any harm resulting from your use of all or any part of the Membership. We shall not be liable to you for any damages, including lost profits, whether such claim is based on warranty, contract, tort or otherwise (even if we have been advised in advance of the possibility of such damages).

 

  1.  Privacy and Confidentiality

Your privacy and protection of your personal data is important to us. You are responsible for ensuring that your contact details are accurate and up-to-date, at the time of registration, and on an on-going basis thereafter.

 

Your personal data is protected as set out in our privacy policy which can be found in the ARC PRIVACY POLICY. By providing your personal data you agree to the terms of our privacy policy.

During the course of the Membership you may have access to confidential information, in particular the personal affairs of other members. In accepting these Terms, you agree that you will not use or disclose to any person, organization or company, and shall use your best endeavors to prevent the publication of, any confidential information relating to any other member.  

 

You accept that any unauthorized disclosure of personal or confidential information belonging to another may amount to immediate dismissal from the Membership. Should you decide to leave the Membership then you remain bound by the confidentiality and privacy obligations.

 

Please be aware that some training sessions may be recorded and your name and image/video may be captured. The recordings of the training will be kept and made available to others in the Membership. If you provide or share any information within these sessions about yourself or your business that information will be shared within the group. Should you not wish to be recorded please ensure that if you attend any training your camera is switched off and your name field is changed to “Attendee” with your initials so that support can still be offered but no personal identifiable information will be captured.

 

Your log-in details must remain confidential, and you must not disclose this information to a third party, without our express permission in writing. If you know, or suspect, that your log-in details have been obtained by a third party, you agree to change your password immediately, and provide notification of the same as soon as possible to [email protected] .

 

  1.  Intellectual Property

During your time as a Member you will be provided with video training videos, live-calls, and webinars. At all times the intellectual property rights and copyrights connected with those materials remain with us. You have the right to use the materials as learning tools but you are not permitted to duplicate, republish, reproduce, distribute, translate or provide copies to third parties. We retain and reserve all of our copyrights.

 

  1.  Non-Compete

By becoming a Member of ARC you agree that while in Membership, and for a period of 6 months following termination or cancellation of your Membership, you shall not elicit or entice away any current or potential members. You also agree not to become involved in any capacity with any business concern which is in, or tends to be in, direct competition with ARC.

 

  1.  Errors and Inaccuracies

There may be information within our Site or the Membership which contains typographical errors, inaccuracies or omissions relating to the service delivery, pricing or promotion of the Membership. We reserve the right to correct or amend any errors without prior notice.

 

  1.  Dispute Resolution and Jurisdiction

Before filing a claim against Josie Lewis Art you agree to try to resolve the dispute informally by contacting [email protected].  It is our aim to try to resolve the dispute directly with you within 15 days of filing.

If we are unable resolve the dispute directly with each other, then both parties will agree to use final and binding arbitration by a single arbitrator. The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules. The arbitration will be held in the United States with St. Paul, Minnesota, unless another location is mutually agreed upon.
